Germany Permits Distance Selling — With Real Conditions Attached
Article 18 of the EU Tobacco Products Directive lets each member state decide whether to allow cross-border online tobacco sales to its residents. Germany chose to allow it, but not without safeguards. Since 1 April 2016, § 10(3) of the Jugendschutzgesetz (Youth Protection Act) has required every online and mail-order tobacco seller to use an age-verification system before a sale is even completed — not just a checkbox at checkout, but a genuine check that the buyer meets the legal minimum age.
Face-to-Face Control: The Rule Most Shoppers Never Hear About
The most distinctive part of German tobacco law is what happens at delivery, not at checkout. Shipments must be handed over under so-called "Face-to-Face-Kontrolle" — the courier is required to confirm that the parcel is received by the person who placed and verified the order, not simply left at the door or with a neighbour. Retailers selling cross-border into Germany must also register with the competent German authority before trading, and every pack, box or tin sold into the country must carry a German tax stamp (Steuerbanderole) proving the correct excise duty has been paid.
